The Government’s Auto Insurance Changes - What You Need to Know
• As you know the Provincial Government has passed Legislation which will drastically reduce the benefits that people will be entitled to recover if involved in a car accident on or after September 1, 2010. From our perspective we would be remiss as a Personal Injury Law Firm if we did not remind our friends and clients to take the necessary steps to protect themselves and their families by encouraging them to review their car insurance coverage in light of the legislative changes.
For example, if your renewal of your auto insurance policy is after September 1, 2010, available medical and rehabilitation benefits, in standard auto insurance policies, will be reduced from $100,000.00 to $50,000.00 and attendant care benefits will be reduced from $72,000.00 to $36,000.00 for persons who sustain non-catastrophic injuries. Housekeeping benefits (formerly up to $100.00 per week) and caregiver benefits (formerly starting at $250.00 per week) will be eliminated.
This said, the insurance companies are prepared to provide you with levels of coverage that you might be more comfortable with, but unfortunately at a higher price. To protect yourself and your family you need to consult with your insurance broker or your insurance company to decide if the enhanced coverage is appropriate for you.
• With respect to any patients/persons that you might be dealing with after September 1st, and keeping in mind the implementation of the insurance changes can be very confusing, we want to make sure that any educational information you give out is correct. As such, we have produced Statutory Accident Benefits Schedule Charts that provide a summary of the changes. In addition, we have redesigned and revised our Personal Injury Information Kits to reflect the new legislative changes. The
kits come with the new accident benefit forms. If old forms are used, the benefits will be delayed or refused. If you would like a kit to be sent to you as an educational resource manual, just send your contact information by email to jpileggi@thomsonrogers.com.
While the Provincial Government has passed the Legislation, certain guidelines, forms, and other measures are continuously being released by FSCO. • On September 30, 2010 in collaboration with the Toronto ABI Network, we will be hosting the Second Annual Back-to-School Conference at the Four Seasons Hotel Toronto. The first half of the conference is to bring everyone up-to-date on the new S.A.B. legislation. The second component deals with patients being released from the hospital and having to contend with issues concerning their employment, relationships and lifestyle.
Immediately following the conference, a special presentation and cocktail reception will be held in honour of Mr. John Kumpf, who after 12 years as Executive Director of the Ontario Brain Injury Association, has decided to retire.
