From a 1% Whole Person Impairment CAT DAC to a 79% Whole Person Impairment at Arbitration.

David Payne, one of our partners at Thomson, Rogers, recently won a decision from the Ontario Financial Services Commission rectifying a Designated Assessment Centre finding. The Designated Assessment Centre had determined that our client had only had a 1% Whole Person Impairment and was therefore not a catastrophic claimant. At the Arbitration, David Payne successfully argued that our client had a 79% Whole Person Impairment, and was therefore a catastrophic claimant.
