On January 15, 2010, THOMSON, ROGERS issued a national Class Action lawsuit on behalf of all Canadians who have received a Trident® Ceramic Acetabular System (the “Device”), alleging that the Device causes audible noises including squeaking, screeching, popping and cracking (“Squeaking”) and may loosen from the patient’s acetabulum resulting in severe pain.

The Class Action claim seeks millions of dollars in compensation from Stryker Corporation, Howmedica Osteonics Corporation and their alleged Canadian affiliates (together referred to as the “Defendants”) who are alleged to be responsible  for designing, testing, manufacturing, assembling, licensing, marketing, distributing, importing and selling the Device in Canada.

The representative plaintiff, Ms. Maryanne Tascione from Vaughan, Ontario claims that she experienced squeaking from the Device and is at risk of having the Device loosen.

She states: “My device squeaks all day long and affects almost every aspect of my daily life.   It is humiliating, and my doctor says that my only option is to replace the device, but I am only 49 years old and that is a risky procedure. This ceramic device has failed me.”
