Thomson Rogers personal injury lawyer Stephen Birman was interviewed on Newstalk 580 CFRA discussing recent Government of Ontario legislation providing COVID-19 liability protection to businesses, workers and some organizations, including long-term care facilities.
In discussing the legislation and the government’s push to protect insurance companies Birman says,
“I’m not sure why there’s this push to protect the insurance companies and especially to do it in a retroactive way,” said Birman. “The legislation basically says ‘rights are extinguished,’ which is a pretty dramatic and unusual thing to just extinguish rights for those who are currently part of lawsuits.”
“It really is adding insult to injury to our plaintiffs and claimants.”
